DMCA COPYRIGHT POLICY

Effective Date: August 12, 2024

1. Introduction

PasteCode.io (“Platform”, “Service”, “we”, “us”, “our”) respects the intellectual property rights of others and expects users to do the same. This policy explains how we process notices of alleged copyright infringement under the U.S. Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512.

If you believe content on PasteCode.io infringes your copyright, please submit a compliant takedown notice as described below. We will remove or disable access to allegedly infringing material upon receipt of a valid notice.

2. Designated Copyright Agent

You may submit DMCA notices to our Designated Agent via:

3. How to File a DMCA Takedown Notice (17 U.S.C. § 512(c)(3))

Your written notification (“Takedown Notice”) must include all of the following:

  1. A physical or electronic signature of a person authorized to act on behalf of the copyright owner.
  2. Identification of the copyrighted work(s) claimed to have been infringed (or a representative list).
  3. Identification of the material claimed to be infringing, with information reasonably sufficient to locate it (including the specific URL(s)).
  4. Your contact information: full legal name, mailing address, telephone number, and email address.
  5. A statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement under penalty of perjury that the information is accurate and that you are authorized to act on behalf of the owner of an exclusive right allegedly infringed.

Send your Takedown Notice to legal@pastecode.io or via /contact. Notices that do not substantially comply with the DMCA may not be processed.

4. What Happens After We Receive a Valid Notice

Upon receipt of a valid Takedown Notice, we will act expeditiously to remove or disable access to the allegedly infringing material. We will make a good-faith effort to notify the user who posted the material and provide information about submitting a counter-notification.

5. Counter-Notification Procedure (17 U.S.C. § 512(g))

If you believe your content was removed or disabled due to mistake or misidentification, you may submit a written counter-notification (“Counter-Notice”) that includes all of the following:

  1. Your physical or electronic signature.
  2. Identification of the material removed or disabled and the URL where it appeared before removal/disablement.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your full legal name, mailing address, telephone number, and email address.
  5. A statement that you consent to the jurisdiction of a U.S. Federal District Court appropriate under 17 U.S.C. § 512(g), and that you will accept service of process from the original complainant or their agent.

Send your Counter-Notice to legal@pastecode.io or via /contact. Counter-notices that do not substantially comply with the DMCA may not be processed.

6. Counter-Notice Processing Timeline

  • We will promptly forward a copy of a valid Counter-Notice to the original complainant.
  • Unless we receive notice that the complainant has filed a court action seeking to restrain the user from engaging in infringing activity, we may restore the material not less than 10 and not more than 14 business days after receiving the valid Counter-Notice.

7. Repeat Infringer Policy (17 U.S.C. § 512(i))

PasteCode.io maintains and reasonably implements a policy to terminate, in appropriate circumstances, users who are repeat infringers. We may also limit access or terminate accounts for severe violations or where required to mitigate legal or safety risks.

8. Misrepresentation (17 U.S.C. § 512(f))

Any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys’ fees.

9. Standard Technical Measures (17 U.S.C. § 512(i))

PasteCode.io accommodates and does not interfere with standard technical measures used by copyright owners to identify or protect copyrighted works, as defined in 17 U.S.C. § 512(i).

10. Good Faith Removal

PasteCode.io acts in good faith when disabling access to or removing content claimed to be infringing, and may remove content at its discretion, including content that violates our Terms of Service or creates legal risk.

11. Changes to This Policy

We may update this policy from time to time. Changes are effective upon posting. Continued use of the Service after changes are posted constitutes acceptance of the updated policy.
